Lawyers for Harvey Weinstein, who has been accused of sexual misconduct and rape by 80+ women, asked a judge on Monday to throw out the criminal case against him, Page Six reports. One of his accusers tried to meet with him soon after she claims he abused her, Weinstein’s team alleges. According to the motion, accuser Mimi Haleyi texted Weinstein’s phone after the alleged attack: “Hi! Just wondering if u have any news on whether harvey will have time to see me before he leaves? x Miriam.” Ben Brafman argued in the filing: “This message makes clear that Mimi Haleyi wished to continue seeing Mr. Weinstein even after the alleged sexual assault.” Last month, a judge dismissed the felony count against Weinsten related to a third victim named Lucia Evans over credibility concerns. Page Six writes that the D.A. is expected to issue a response later this month.
