He’ll have to stick to prison Jell-O for now.
Montgomery County Court Judge Steven O’Neill ruled that the 81-year-old, who was sentenced to 3-10 years behind bars for sex assault, will now have to take his appeal to a higher court.
In a one-page order, O’Neill wrote that “following an exhaustive review of the record” he found no basis for a hearing on any of the issues raised by the 81-year-old or his legal team.
Cosby now has 30 days to file a direct appeal to the Pennsylvania Superior Court.
His lawyers had argued that O’Neill failed to properly consider factors such as Cosby’s advanced age and blindness when he sentenced him on Sept. 25.
Prosecutors in turn said that despite those factors, the former Jell-O pitchman was still a dangerous “Sexually Violent Predator” with a likelihood to re-offend.
